Introduction

Hankerin’ (“we,” “our,” or “us”) helps customers discover nearby local food producers and stands, view stand information and available products, see whether a stand is open or closed, and get directions. It also provides Producer Account tools that allow food producers to manage public stand information, product listings, and stand availability. This Privacy Policy explains what information we collect, how we use it, and the choices available to you.

By using the Hankerin’ mobile application and related services (the “Service”), you acknowledge that information may be collected and used as described in this Privacy Policy.

Information We Collect

Information You Provide

Customers do not need to create an account or log in to find nearby stands, view stand and product information, see whether a stand is open or closed, or get directions. If you create a Hankerin’ Producer Account, we may collect:

• Producer name or contact name
• Email address
• Account credentials managed through our authentication provider
• Farm, organization, or stand name and description
• Stand address, location, hours, and open or closed status
• Product listings and availability information

Location Information

With your permission, we may collect your device’s location to help you:

• Find nearby stands
• Get maps and directions to stands
• View stands relevant to your current or selected area
• Improve search results based on proximity

You may deny or revoke location access through your device settings at any time. Some features may not function properly without location access.

Customers may also search using a manually entered location. Manual search locations are used to return relevant nearby stand results, including stand details, product information, open or closed status, and directions. Hankerin’ does not require customers to create an account to use location-based or manually entered search features.

Customer location information is used temporarily to provide nearby search results, stand information, product availability, open or closed status, maps, and directions. Hankerin’ does not create customer accounts for stand searches, does not store customer location information in Hankerin’s application database in connection with these features, and does not maintain a history of customer locations. Customer location information is not sold, rented, or shared with other users. Third-party services, such as mapping providers, may process location information as needed to provide maps, directions, or related Service functionality.

Producer Account stand locations are stored so that stands can appear in search results and on maps.

Automatically Collected Information

Depending on the features and services enabled within the Service, we may collect certain technical information, including:

• Device type
• Operating system
• App version
• Diagnostic information and crash reports
• Usage analytics
• Search activity within the app

This information helps us improve the Service and troubleshoot issues.

Information We Do Not Collect

Hankerin’ does not intentionally collect certain sensitive information from customers or producers, including:

• Payment card information
• Social Security numbers
• Government-issued identification numbers
• Health information
• Biometric information

How We Use Information

We use collected information to:

• Operate and maintain the Service
• Display nearby stands, stand information, products, and open or closed status
• Provide maps and directions to stands
• Authenticate and manage Producer Accounts
• Improve app functionality
• Respond to support requests
• Monitor app performance and security
• Comply with legal obligations
• Allow producers to add, remove, and update stand and product information
• Allow producers to mark stands as open or closed

Sharing of Information

We do not sell your personal information.

We do not use personal information to track users across apps or websites owned by other companies for advertising purposes.

We may share information with trusted service providers that help us operate the Service, including:

• Supabase (data storage and authentication)
• Google Maps Platform (mapping and location services)
• Analytics and crash reporting providers

These providers may process information solely for purposes related to providing and maintaining the Service.

We may also disclose information if required by law or to protect our legal rights.

Business Transfers

If Hankerin’ LLC is involved in a merger, acquisition, financing, asset sale, or other business transaction, information covered by this Privacy Policy may be transferred as part of that transaction.

Public Information

Information submitted through Producer Accounts for public display may be visible to customers and other users, including:

• Farm, organization, or stand name
• Farm, organization, or stand description
• Stand location, which may appear in search results or on a map
• Product listings
• Product availability information

Please do not submit information through a Producer Account that you do not want displayed publicly.

Data Retention

We retain Producer Account information for as long as the account remains active or as needed to provide the Service. Public stand and product information remains available until it is removed by the producer, the account is deleted, or we remove it in accordance with our policies. We may retain certain records for a longer period if required for legal, security, fraud prevention, dispute resolution, or operational purposes.

Data Security

We use commercially reasonable measures to protect information stored through the Service. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

Children’s Privacy

The Service is not directed to children under 13 years of age. We do not knowingly collect personal information from children under 13.

If we learn that a child under 13 has provided personal information, we will take steps to delete that information.

Your Choices

You may:

• Disable location access through your device settings
• Request access to your information
• Request correction of inaccurate information
• Request deletion of your Producer Account and associated personal information

We will process deletion requests within a reasonable period, subject to legal, security, fraud prevention, dispute resolution, or operational retention requirements. Customers who do not create an account do not have an account to delete.

Third-Party Services

The Service may rely on third-party services and websites. We are not responsible for the privacy practices of third parties.

Changes to This Privacy Policy

We may update this Privacy Policy periodically. Changes will become effective when posted.

Hankerin’ Terms of Service

1. Acceptance of Terms

Welcome to Hankerin’.

These Terms of Service ("Terms") govern your access to and use of the Hankerin’ mobile application, website, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years old, or older if required by applicable law, to use the Service.

If you create or manage a Producer Account, you represent that you are authorized to act on behalf of the stand, farm, business, organization, or producer associated with that account.

3. Privacy Policy

Your use of the Service is also governed by Hankerin’s Privacy Policy.

4. Description of the Service

Hankerin’ helps customers discover local food producers and stands, view stand information and product listings, determine whether a stand is open or closed, and obtain directions.

Hankerin’ also provides Producer Account tools that allow food producers to manage stand information, product listings, and stand availability.

Hankerin’ is an informational and discovery platform. Hankerin’ does not sell, distribute, inspect, deliver, or guarantee any products listed through the Service.

5. Producer Responsibility for Content and Compliance

Producers are solely responsible for information submitted through Producer Accounts, including:

• Stand names and descriptions
• Locations
• Hours of operation
• Open or closed status
• Product listings
• Product availability information

Producers are responsible for ensuring that information they provide is accurate and current.

Producers are solely responsible for complying with all applicable laws, regulations, permits, food safety requirements, cottage food requirements, taxes, zoning requirements, and other legal obligations related to their operations.

6. User Content and License to Hankerin’

You retain any rights you may have in content you submit to the Service.

By submitting content to the Service, you grant Hankerin’ a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, display, publish, distribute, adapt, format, modify for technical or presentation purposes, promote, and otherwise use that content in connection with operating, improving, securing, marketing, and providing the Service.

7. No Guarantee of Accuracy

Information available through the Service may change at any time.

Hankerin’ does not guarantee:

• A stand is open when displayed as open
• A stand is closed when displayed as closed
• Products shown as available remain available
• Locations, directions, or maps are accurate
• Information provided by producers is complete, accurate, or current

8. Safety, Travel, and Location Information

Users are solely responsible for traveling safely, obeying traffic laws, respecting private property, evaluating whether a location is safe and accessible, and independently confirming stand availability before visiting.

9. No Professional Advice

Information provided through the Service is for informational purposes only and should not be considered legal, tax, agricultural, food safety, business, health, nutritional, or other professional advice.

10. Food Products and Producer Relationships

Hankerin’ is not a producer, seller, distributor, retailer, broker, or agent for any food products.

Any transaction, purchase, exchange, communication, or interaction between a customer and a producer occurs directly between those parties.

11. User Conduct

Users agree not to:

• Use the Service for unlawful purposes
• Attempt to interfere with the operation of the Service
• Access accounts that do not belong to them
• Upload false, misleading, or fraudulent information
• Attempt to reverse engineer or disrupt the Service
• List illegal, unsafe, recalled, or prohibited products

12. Producer Accounts

Producer Accounts are intended for legitimate food producers and stand operators.

13. Intellectual Property

The Service, including its design, software, trademarks, logos, graphics, text, and other content, is owned by or licensed to Hankerin’ LLC and protected by applicable intellectual property laws.

14. Third-Party Services

The Service may rely on third-party services including mapping, hosting, authentication, analytics, and location providers.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANKERIN’ LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

IN NO EVENT SHALL HANKERIN’S TOTAL LIABILITY EXCEED $100 USD.

17. Indemnification

You agree to defend, indemnify, and hold harmless Hankerin’ LLC and its affiliates, owners, members, employees, and contractors from claims arising from your use of the Service or violation of these Terms.

18. Termination

We may suspend, restrict, or terminate access to the Service at any time.

19. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

20. Force Majeure

Hankerin’ shall not be liable for interruptions or failures caused by events beyond its reasonable control.

21. Changes to These Terms

We may update these Terms periodically. Continued use of the Service constitutes acceptance of updated Terms.

22. Governing Law

These Terms are governed by the laws of the State of Kansas.

Any legal action arising from these Terms shall be brought exclusively in a state or federal court located in Kansas.

23. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
